1. Introduction

These terms and conditions govern your participation in the Modak Survey Campaign for Kids Who Invited Their Parents (the “Campaign”). This Campaign is designed to help us better understand our users and improve the experience for kids who sign up and invite their parents to join. By participating, you agree to these terms and conditions. Please read them carefully, and if you do not agree, we kindly ask that you do not participate.

Additionally, it's important to note that most of our campaigns are focused on promoting our products and services through various initiatives such as referral programs, contests, interviews, and educational activities aimed at enhancing kids' involvement with financial knowledge.

By participating, you agree to be fully and unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Modak as final and binding as it relates to the content. The Campaign is subject to all applicable federal, state, and local laws.

2. Eligibility:

• Age Requirement: Participants must be teenagers within the age range of 13–17 years old at the time of entry. Proof of age may be required upon request.
• Geolocalization: The Campaign is only open to legal residents of the United States and is void where prohibited by law. Employees of Modak (the “Sponsor”), their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers, and their immediate family members and/or those living in the same household of each are not eligible to participate in the Campaign. The Campaign is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.
• This Campaign is open to kids and teens who signed up for Modak independently, invited their parent or legal guardian, and successfully completed the onboarding process, including the approval of their bank account. The survey is exclusively for kids and teens, not for parents or guardians.
• To qualify for the reward, participants must:

• Complete the survey in full – all questions must be answered.
• Provide meaningful responses – answers should be thoughtful and complete, not just one-word replies.

We want to hear real experiences to help improve Modak. Here are examples of what we consider a good answer and what we do not consider a good answer:

Good answer example:

Q: What made you decide to create your Modak account?

"I wanted to start saving up for a new skateboard, and my parents always told me it’s good to learn how to manage money early. I liked that I could track my savings and get money from my family easily."

Not a good answer example:

"Because I wanted to."

Good answer example:

Q: What did you tell your parent/guardian about Modak?

"I told my dad that Modak would help me save money for things I really want, and that it’s safe because parents can see everything too."

Not a good answer example:

"That it’s cool."

‍

We encourage all participants to share their honest thoughts and experiences so we can make Modak even better for kids like you.

3. How to participate:

The entry must fulfill all Campaign requirements, as specified, to be eligible to win the reward. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Modak.

4. Limits/exceptions:

‍

• Age Limitation: Participation in the Modak Survey Campaign for Kids Who Invited Their Parents is restricted to users aged 13–17 years old. Only teens within this age range are eligible.
• Entry Limit: Each eligible participant may submit one survey entry. Only one survey response per Modak account will be accepted. Duplicate entries, incomplete responses, or automated submissions may result in disqualification at Modak’s sole discretion.
• Response Quality Requirement: To qualify for the reward, responses must be thoughtful and complete. One-word or low-effort answers (e.g., “I don’t know” or “Because I wanted to”) will not be considered valid.
• Standalone Incentive: This Campaign is a separate initiative from any other Modak referral or promotional programs. Participation in this survey does not affect referral program limits or eligibility for other rewards.

5. Promotion Period: 

The Modak Survey Campaign for Kids Who Invited Their Parents will be active and open for participation beginning on March 12, 2025, and will remain open until further notice. Modak reserves the right to modify or terminate the Campaign at any time, at its sole discretion.

Please note that only entries submitted while the Campaign remains active will be considered eligible for participation.

6. Prize: 

‍

Participants who apply for the Campaign will receive a digital gift card of their choice — Roblox or Amazon — with an approximate retail value of $10 USD. Actual/appraised value may differ at the time of prize award. The specifics of the prize shall be solely determined by the Sponsor.

No cash or other prize substitution is permitted except at the Sponsor's sole discretion. The prize is non-transferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted.

Acceptance of the prize constitutes permission for Modak to use the winner's name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

Please note that gift cards will be sent out every Friday to participants who meet all the requirements.

6. Reward Notification

‍

Notifications regarding reward redemption (e.g., delivery of the digital gift card) will be sent via email to the address associated with the participant’s Modak account. Gift cards will be sent out every Friday to participants who meet all the requirements.

Modak shall have no liability for a participant's failure to receive notifications due to spam filters, junk email settings, incorrect or inactive contact information, or any other delivery issues beyond Modak’s control.

If a participant fails to claim or redeem their prize within seventy-two (72) hours of notification, Modak reserves the right to revoke the prize without substitution.

‍

The receipt of any prize in this Campaign is conditioned upon full compliance with all applicable federal and state laws and regulations. Any violation of these official rules by any participant (at the Sponsor’s sole discretion) will result in disqualification and termination of any prize-related privileges.

8. Rights Granted by you: 

By participating in this Campaign, you understand and agree that Modak, anyone acting on behalf of Modak, and its respective licensees, successors, and assigns shall have the right, where permitted by law, without any further notice, review, or consent, to print, publish, broadcast, distribute, and use—worldwide and in perpetuity, in any media now known or hereafter developed—your participation information, including but not limited to your name, portrait, picture, voice, likeness, image, statements about the Campaign, and biographical information, for purposes of news, publicity, trade, advertising, public relations, and promotional efforts, without any further compensation.

8. Liability and Disputes

By participating in this Campaign, you agree to release and hold harmless Modak and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) your participation in the Campaign and/or your acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware, or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the participation process or the Campaign; (v) electronic or human error which may occur in the administration of the Campaign or the processing of participation data.

• Limitation of Liability: Modak shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with your participation in the Modak Survey Campaign for Kids Who Invited Their Parents, including but not limited to issues related to prizes, rewards, or use of (or inability to use) Modak services.
•  Dispute Resolution: We strive to ensure that participating in the Campaign is a positive experience for all involved. In the unlikely event that a dispute arises, we encourage open communication and cooperation to resolve any concerns.

THIS CAMPAIGN IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF DELAWARE, WITHOUT REGARD TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Campaign, you agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Campaign, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Delaware having jurisdiction. Under no circumstances will participants be permitted to obtain awards for, and hereby waive all rights to claim, punitive, incidental, or consequential damages (including reasonable attorneys’ fees), other than actual out-of-pocket expenses (i.e., costs associated with entering the Campaign). Participants further waive all rights to have damages multiplied or increased.

• Informal Resolution and Arbitration: We believe in resolving disputes amicably and encourage you to first reach out to us directly to discuss any concerns you may have. Our team is here to listen and work with you to find a satisfactory solution. If a resolution cannot be reached informally, any disputes, claims, or controversies arising from or related to the Campaign shall be resolved through binding arbitration. The arbitration will be administered by a mutually agreed-upon arbitration provider. The arbitration will be conducted in accordance with the rules and procedures of the chosen arbitration provider. The process will be fair and transparent, and the decision of the arbitrator will be final and binding on all parties involved. Each party shall bear its own costs associated with the arbitration proceedings. We strive to minimize any financial burden on all parties involved.
• Governing Law and Jurisdiction: These Terms and Conditions shall be governed by and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms and Conditions or the Campaign shall be brought exclusively in the courts of Delaware, United States, and you hereby consent to the jurisdiction of such courts.

At Modak, we take the privacy and security of your information seriously. We are committed to protecting your data and ensuring that it is handled responsibly and securely.

• Collection of Information: We collect certain personal information from you when you participate in the Campaign, to facilitate your participation and administer the Campaign effectively. This may include information such as your name, email address, and platform-related activity. Rest assured, we only collect information that is necessary for the Campaign and in accordance with our Privacy Policy.
• Use of Information: The information collected from you may be used to communicate with you regarding the Campaign, notify you of any updates or changes, and facilitate the distribution of prizes or rewards. We may also aggregate and analyze data for statistical purposes to improve our services and offerings.
• Security Measures: We have implemented robust security measures to safeguard your personal information from unauthorized access, disclosure, alteration, or destruction. 10. General Terms and Conditions:

By accessing and using our services, including participating in the Modak Survey Campaign for Kids Who Invited Their Parents, you agree to abide by these general terms and conditions. Please read them carefully. If you do not agree with any part of these terms, we kindly ask that you refrain from using our services.

• Participant Conduct: Participants are expected to conduct themselves in a respectful and responsible manner while participating in the Campaign. Any behavior that violates these Terms and Conditions or engages in fraudulent activity will result in disqualification. Modak reserves the right, in its sole discretion, to maintain the integrity of the Campaign and to void entries for any reason, including but not limited to:
  
  • Multiple entries from the same user using different IP addresses;
  • Multiple entries from the same device in excess of what is permitted;
  • The use of bots, macros, scripts, or other technical means of participation.
• Technical Issues: Modak is not responsible for any technical issues that may affect participation in the Campaign, including but not limited to internet outages, server downtime, or software malfunctions. Every effort will be made to promptly address and resolve any such issues.
• Compliance with Laws: Participation in the Campaign is subject to all applicable local, state, and federal laws and regulations. Participants are solely responsible for ensuring compliance with any laws that may apply to their participation.
• Amendment or Cancellation: Modak reserves the right to amend or cancel the Campaign at its discretion, without prior notice. In the event of cancellation, Modak will make reasonable efforts to notify participants and provide appropriate compensation if applicable.
• Ineligibility and Misconduct: Any attempt by a participant to deliberately damage any website or undermine the legitimate operation of the Campaign may constitute a violation of criminal and civil laws. Should such an attempt be made, Modak reserves the right to seek damages to the fullest extent permitted by law.
• Consent to Terms: By participating in the Campaign, you acknowledge and agree to abide by these Terms and Conditions. Modak reserves the right to take appropriate action, including disqualification, against any participant who violates these terms.
• Communications: By participating in the Campaign, you agree to receive periodic email communications from Modak, including newsletters and updates. You may opt-out at any time by clicking the unsubscribe link included in such communications.
• Review of Terms: Participants are encouraged to review Modak’s Privacy Policy and Terms of Service, which govern the broader use of our services, in addition to these Campaign-specific Terms and Conditions.

Winners List: To obtain a copy of the winner's name or a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope to: Modak Communities Operating Holdings Inc. 3000 SAND HILL RD, BUILDING 4 SUITE 230, MENLO PARK, CALIFORNIA 94025. Requests must be received no later than 10 business days after the end of the Modak Survey Campaign for Non-Banked Users.
