1. Introduction
These terms and conditions govern your participation in our exciting campaign designed to empower kids and promote financial literacy. By accessing and using our services, including participating in the New Card Unboxing Campaign, you agree to abide by these terms and conditions. Please read them carefully. If you do not agree with any part of these terms, we kindly ask that you refrain from using our services.
Additionally, it's important to note that most of our campaigns are focused on promoting our products and services through various initiatives such as referral programs, contests, interviews, and educational activities aimed at enhancing kids' involvement with financial knowledge.
By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Modak, as final and binding as it relates to the content. The Promotion is subject to all applicable federal, state and local laws.
2. Eligibility:
- Geolocalization: The Promotion is only open to legal residents of the United States and is void where prohibited by law. Employees of Modak (the “Sponsor”) their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Promotion. The Promotion is subject to all applicable federal, state and local laws and regulations. Void where prohibited.
- Requested new card: The promotion is only valid for users who requested a new Modak physical debit card since 07/07/2025
- Multiple Children: If a parent has more than one child with eligible Modak accounts (i.e., each has requested a new physical debit card), they may submit a separate application for each child. Each submission will be treated independently for review, eligibility, and prize distribution. Duplicate submissions using the same video or email address will not be considered.
- Unboxing video eligibility: To be eligible for the 200 MBX first prize, participants must upload a video of the child unboxing their new physical Modak debit card and provide the email linked to the child’s Modak account. While the child can upload the video, a parent must accept the terms and conditions for the entry to count. The video must be at least 10 seconds long, filmed vertically in a well-lit space, and clearly show both the Modak card and the child’s reaction through expressions, gestures, or clear audio.
- Social media post eligibility: To be eligible for the 100 MBX second prize, participants must share the unboxing video on Instagram, TikTok, or Facebook as a post or story, tagging Modak’s official account (@modakmakers). Stories must remain live for at least 12 hours. Posts in feeds must remain live for at least 72 hours. A screenshot of the post must be uploaded as proof within the same Typeform submission. Please note that only one social media post per parent qualifies for the 100 MBX reward, regardless of the number of children entered.
3. How to participate:
Visit the campaign landing page at (Insert URL here) and fill out the Typeform, which has two quick sections: one to upload your child’s unboxing video and another to share proof of your social media post.
- First Prize: Unboxing video
- Upload a video of your child unboxing their new physical Modak debit card.
- Provide the email address associated with the Modak child account that owns the card.
- Children may upload the video themselves, but a parent must accept these terms and conditions for the submission to be valid.
- The video must meet the following minimum quality requirements:
- Clearly show the Modak card being unboxed and your child’s reaction.
- Be filmed in a well-lit environment where your child and the card are visible.
- Include clear audio, or clearly show your child’s excitement through expressions and gestures.
- Be filmed in vertical (portrait) format, suitable for mobile and social media.
- Be at least 10 seconds long.
- Second Prize: Social media post
- Share the same unboxing video on Instagram, TikTok, or Facebook. This can be done either as a story or a post.
- Tag Modak’s official profile (@modakmakers) in the post.
- Ensure the story remains live for at least 12 hours and posts in feeds should remain live for at least 72 hours .
- Upload a screenshot of your post as proof within the same Typeform at the time of your submission.
- Only one social media post per parent will be eligible for the 100 MBX reward, even if the parent submitted multiple entries for different children.
- Bonus Prize: 200 MBX for Standout Social Media Stars!
An additional 200 MBX will be awarded to participants whose social media videos are selected by Modak as standout entries. These winning videos will be reposted on Modak’s official social media accounts (@modakmakers). Modak will notify the selected participants via email from our official account before their child’s video is featured.
4. Limits/exceptions:
- Only users who submit a valid email address linked to a Modak child account that has recently requested a physical debit card will be eligible for the campaign. Prizes will be credited exclusively to those verified Modak accounts.
- Modak reserves the right to modify, suspend, or terminate the promotion at its sole discretion, at any time and for any reason, without prior notice. In the event of such modification, suspension, or termination, participants will not be entitled to any compensation or additional benefits.
- Multiple Children: If a parent has more than one child with eligible Modak accounts (i.e., each has requested a new physical debit card), they may submit a separate application for each child. Each submission will be treated independently for review, eligibility, and prize distribution. Duplicate submissions using the same video or email address will not be considered.
5. Promotion Period:
The New Card Unboxing Campaign will be active and open for participation between 07/07/2025 and 08/07/2025 11:59PM PST. Please note that entries submitted outside of this promotion period will not be considered eligible for participation in the campaign.
6. Prize:
Participants who complete all requirements of the promotion will be eligible for the following prizes independently:
- First Prize, Unboxing video: 200 MBX will be credited to the Modak account of the participants who submit a valid application, including the unboxing video and the child’s account email address.
- Second Prize, Social media post: 100 MBX will be credited to the Modak account of the participants who share their unboxing video on social media (Instagram, TikTok, or Facebook) and tag Modak's profile (@modakmakers).
- Bonus Prize: 200 MBX for Standout Social Media Stars! Modak will credit 200 MBX to the accounts linked to the most outstanding social media videos, as selected at our discretion. Winning entries will be featured on our official social media channels (@modakmakers), and the MBX will be credited directly to the associated Modak account.
The payments will be processed separately for each completed objective. The child account associated with the profile email address provided in the application, which must match the email of the child who owns the physical debit card being unboxed, will receive the prize within 3 business days following the completion of each stage of the promotion. The prize is non-transferable. Any and all expenses related to the prize, including but not limited to federal, state, or local taxes, are the sole responsibility of the winner. Substitution of the prize, transfer or assignment of the prize to others, or requests for a cash equivalent are not permitted. By accepting the prize, the winner grants Modak permission to use their name, likeness, and entry for advertising and promotional purposes without further compensation, unless prohibited by law.
7. Rights Granted by you:
By participating the parent agrees to the viewing, retention, and sharing of the likeness, image, audio, and/or video in whole or part of the individual(s) contained therein submitted for participation in the Unboxing Campaign for a length of time determined by the Sponsor and to be re-used at anytime at the Sponsor’s discretion. I understand and agree that these materials will become the property of the Sponsor and will not be returned. I hereby irrevocably authorize the Sponsor to edit, alter, copy, exhibit, publish, or broadcast my likeness at any time by means of any media, including print, video presentations, television, radio and satellite transmissions or rebroadcasts, news bulletins, mailers, billboards or signs, brochures, website placements, podcasts, social media posts, or other digital delivery or publications. Additionally, I waive any right of privacy associated with the likeness as well as the right to inspect or approve the finished product, including written or electronic copy, wherein my likeness appears. Furthermore, I waive any right to royalties or other compensation arising or related to the use of my likeness, except a one-time reward of MBX as specified in the Unboxing Campaign rules. I hereby hold harmless and release and forever discharge the Sponsor from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.
8. Liability and Disputes
By entering this campaign, you agree to release and hold harmless Modak and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant's participation in the Promotion and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries.
- Limitation of Liability: Modak shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with your participation in the New Card Unboxing Campaign, including but not limited to, prizes, rewards, or any use of or inability to use our services.
- Dispute Resolution: We strive to ensure that participating in the New Card Unboxing Campaign is a positive experience for all involved. In the unlikely event that a dispute arises, we encourage open communication and cooperation to resolve.
THIS PROMOTION IS GOVERNED BY THE LAWS OF THE USA AND DELAWARE, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Promotion, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Promotion, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Delaware having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e. costs associated with entering this Promotion), and participant further waives all rights to have damages multiplied or increased.
- Informal Resolution: We believe in resolving disputes amicably and encourage you to first reach out to us directly to discuss any concerns or issues you may have. Our team is here to listen and work with you to find a satisfactory solution.
- Arbitration: If a resolution cannot be reached informally, any disputes, claims, or controversies arising from or related to New Card Unboxing Campaign shall be resolved through binding arbitration. The arbitration will be administered by a mutually agreed-upon arbitration provider. We believe arbitration offers a fair and efficient way to resolve disputes outside of the courtroom.
- Fair Process: The arbitration will be conducted in accordance with the rules and procedures of the chosen arbitration provider. We assure you that the process will be fair and transparent, and the decision of the arbitrator will be final and binding on all parties involved.
- Costs: Each party shall bear its own costs associated with the arbitration proceedings. We understand that legal proceedings can be daunting, and we strive to minimize any financial burden on all parties involved.
- Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of Delaware, US, without regard to its conflict of law principles.
- Jurisdiction: Any legal action or proceeding arising out of or relating to these terms and conditions or New Card Unboxing Campaign shall be brought exclusively in the courts of Delaware, US, and you hereby consent to the jurisdiction of such courts.

- Participant Conduct: Participants are expected to conduct themselves in a respectful and responsible manner while participating in the New Card Unboxing Campaign. Any behavior that violates these terms and conditions or engages in fraudulent activity will result in disqualification from the campaign. Modak has the right, in its sole discretion, to maintain the integrity of the Promotion, to void entries for any reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Promotion rules; or the use of bots, macros or scripts or other technical means for entering.
- Technical Issues: Modak is not responsible for any technical issues that may affect participation in the New Card Unboxing Campaign, including but not limited to, internet outages, server downtime, or software malfunctions. We will make every effort to address and resolve technical issues promptly.
- Compliance with Laws: Participation in the New Card Unboxing Campaign is subject to all applicable laws and regulations. Participants are responsible for ensuring compliance with any local, state, or federal laws that may apply.
- Amendment or Cancellation: Modak reserves the right to amend or cancel New Card Unboxing Campaign at its discretion, without prior notice. In the event of cancellation, Modak will make reasonable efforts to notify participants and provide any necessary refunds or compensation.
- Ineligibility: Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Promotion may be a violation of criminal and civil laws and should such an attempt be made, Modak reserves the right to seek damages from any such person to the fullest extent permitted by law.
- Consent to Terms: By participating in the New Card Unboxing Campaign, participants agree to abide by these general terms and conditions. Modak reserves the right to take appropriate action, including disqualification, against any participant who violates these terms.
