1. Introduction
These terms and conditions govern your participation in the Builders Club Survey campaign designed to gather valuable insights and promote financial literacy. By accessing and completing any survey (the "Campaign"), you agree to abide by these terms and conditions. Please read them carefully. If you do not agree with any part of these terms, we kindly ask that you refrain from participating.
Additionally, it's important to note that most of our campaigns are focused on promoting our products and services through various initiatives such as referral programs, contests, interviews, Surveys, and educational activities aimed at enhancing kids' involvement with financial knowledge.
By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. The Promotion is subject to all applicable federal, state, and local laws.
2. Eligibility: Age Requirement
Teens: Participants must be teenagers within the age range of 13-17 at the time of entry. Proof of age may be required upon request. Parents: Participants must be legal guardians or parents of teens who use Modak services.
Geolocalization: The Promotion is only open to legal residents of United States and is void where prohibited by law. Employees of Modak (the "Sponsor") their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Promotion. The Promotion is subject to all applicable federal, state and local laws and regulations. Void where prohibited.
3. How to Participate
Completion of Builders Club Survey: To be eligible for the reward, participants must complete and submit the Builders Club Survey via the provided Typeform link. Only participants who receive the email invitation and successfully complete the survey are eligible for the reward.
Inclusion of relevant information: Participants must include their teen's email address in the form. The reward will be credited to the teen's Modak account linked to the email address provided. Should the email address not belong to an active Modak account of a kid/teen, no reward will be awarded.
4. Limits/Exceptions
Age Restriction: Only individuals within the specified age range (13-17 for teens) and or parent/guardians may participate.
Survey Limit: Participants can only complete a survey once. Duplicate entries are disqualified.
Account Requirement: Participants must have an active Modak account. If you do not have one, you can create an account via the Modak app.
Employees of Modak, their affiliates, subsidiaries, advertising and promotion agencies, suppliers, and their immediate family members or household members are not eligible to participate.
5. Promotion Period
The Builders Club Survey Campaign will be active starting September 2, 2025, and will continue to run until further notice. There is no fixed end date; Modak may announce a closing date in the future.
Eligible users will have two (2) weeks from the date they first receive an email linking to a Survey Campaign to complete the survey and qualify for the reward. Submissions made after this two-week period will not be eligible for rewards, even if the campaign remains active.
Please note that survey responses submitted outside of this promotion period, or after the two-week eligibility window, will not be considered for participation in the campaign.
6. Prize
Participants who complete the Builders Club evaluation survey will receive 500 MBX credited to their teen's Modak account associated with the email address provided in the form.
Limit: Only one reward per family. Multiple submissions from the same household or family unit will result in only the first valid submission being eligible for the reward.
The specifics of the prize shall be solely determined by the Sponsor. No cash or other prize substitution permitted except at Sponsor's discretion. The prize is non-transferable. Any and all prize-related expenses, including, without limitation, any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted. Acceptance of the prize constitutes permission for Modak to use the winner's name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law. Please note that prizes will be issued within 3 business days after the announcement.
7. Reward Notification
Participants of the Promotion will be manually credited within 3 business days of survey completion. Participants will be automatically notified via Modak app push notification. Modak shall have no liability for a participant's failure to receive notices due to Participants' spam, junk e-mail, app notifications not allowed or other security settings or for participants' provision of incorrect or otherwise non-functioning contact information.
The receipt by the participant of the prize offered in this Campaign is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY PARTICIPANT (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN SUCH PARTICIPANT'S DISQUALIFICATION AS PARTICIPANT OF THE PROMOTION AND ALL PRIVILEGES AS WINNER OF THE REWARD WILL BE IMMEDIATELY TERMINATED.
Rewards will be manually credited within 3 business days of survey completion. Modak is not responsible for delayed rewards due to technical issues or incorrect account details.
8. Rights Granted by You
By entering this Campaign you understand that Modak, anyone acting on behalf of Modak, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, including, without limitation, the entry and winner's name, portrait, picture, voice, likeness, image or statements about the Promotion, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.
9. Liability and Disputes
By entering, you agree to release and hold harmless Modak and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant's participation in the Promotion and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries.
Limitation of Liability: Modak shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with your participation in Builders Club Survey campaign, including but not limited to, prizes, rewards, or any use of or inability to use our services.
Dispute Resolution: We strive to ensure that participating in Builders Club Survey campaign is a positive experience for all involved. In the unlikely event that a dispute arises, we encourage open communication and cooperation to resolve.
THIS PROMOTION IS GOVERNED BY THE LAWS OF THE USA AND DELAWARE, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Promotion, participants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Promotion, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Delaware having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e. costs associated with entering this Promotion), and participant further waives all rights to have damages multiplied or increased.
Informal Resolution: We believe in resolving disputes amicably and encourage you to first reach out to us directly to discuss any concerns or issues you may have. Our team is here to listen and work with you to find a satisfactory solution.
Arbitration: If a resolution cannot be reached informally, any disputes, claims, or controversies arising from or related to Builders Club Survey campaign shall be resolved through binding arbitration. The arbitration will be administered by a mutually agreed-upon arbitration provider. We believe arbitration offers a fair and efficient way to resolve disputes outside of the courtroom.
Fair Process: The arbitration will be conducted in accordance with the rules and procedures of the chosen arbitration provider. We assure you that the process will be fair and transparent, and the decision of the arbitrator will be final and binding on all parties involved.

Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of Delaware, US, without regard to its conflict of law principles.
Jurisdiction: Any legal action or proceeding arising out of or relating to these terms and conditions or Builders Club Survey campaign shall be brought exclusively in the courts of Delaware, US, and you hereby consent to the jurisdiction of such courts.
