Terms and Conditions Support Initiative

These Terms & Conditions (“Terms”) govern participation in the Modak Community Support Initiative (“Program”) offered by Modak.
By submitting a support initiative application or participating in the Program, you agree to these Terms.
By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Modak, as final and binding as it relates to the content. The Promotion is subject to all applicable federal, state and local laws.
1. Program Overview
The Program is a limited promotional pilot that allows eligible Modak users to share approved Modak payment links for community-oriented activities.
Eligible approved campaigns may receive a promotional reward equal to 5% of eligible funds successfully collected through the designated payment link, subject to these Terms.
The Program is intended solely for limited testing, operational evaluation, customer engagement, and payment link usage analysis purposes.
2. Eligibility Requirements
To participate in the Program:
- The parent or legal guardian must have an active Modak account in good standing.
- The account must have been open for at least 30 days.
- The account must demonstrate normal and established account activity.
- Parent or legal guardian approval is required for all campaigns.
- Campaigns are subject to manual operational, fraud, risk, and compliance review.
- Submission of a support initiative application does not guarantee approval.
The Program is available only to eligible U.S. residents with active Modak accounts and where permitted by applicable law.
Employees of Modak (the “Sponsor”) their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Promotion. The Promotion is subject to all applicable federal, state and local laws and regulations. Void where prohibited.
Modak reserves the right to approve, deny, suspend, remove, restrict, or terminate participation at its sole discretion.
All eligibility determinations, reviews, reward calculations, and promotional decisions are made by Modak in its sole discretion and are final.
3. Eligible support initiative Categories
Approved campaigns must fall into one of the following categories:
- Teacher or school staff appreciation
- School supply or classroom drives
- Local community initiatives
- Youth sports or extracurricular activities
- Local family or neighbor support (non-emergency, non-medical)
4. Prohibited Campaigns
The following campaign types are prohibited:
- Medical expenses or health emergencies
- Political campaigns, candidates, or causes
- Religious organizations or causes
- Legal defense, bail, or court-related expenses
- Emergency cash assistance
- Commercial or for-profit purposes
- Campaigns primarily intended for the personal financial benefit of the organizer or their immediate family
- Any activity that violates applicable law, Sponsor Bank requirements, or Modak policies
Modak may remove or deny any campaign that appears misleading, deceptive, abusive, fraudulent, manipulative, or inconsistent with the purpose of the Program.
Modak reserves the right to remove, edit, reject, disable, suspend, or restrict any campaign content, support initiative descriptions, campaign names, images, or payment links that Modak determines may create legal, compliance, reputational, operational, fraud-related, or customer safety concerns.
5. Campaign Requirements
Approved campaigns must comply with the following:
- Supporting goals must be between $50 and $4,000.
- Campaign periods must be between 7 and 30 days.
- Campaign collection periods begin once the payment link is activated by Modak.
- Only payment links specifically issued by Modak for this Program qualify for promotional rewards.
6. Payment Links
Approved users will receive a designated Modak payment link for use in the Program.
Payment links:
- may only be shared directly by the organizer
- are not publicly searchable within the Modak platform
- may not be listed in public fundraising marketplaces operated by Modak
All funds collected through the payment link will be deposited into the parent or legal guardian’s designated Modak account.
Modak provides payment link functionality and promotional incentives only. The Program is not intended to operate as a public crowdfunding marketplace, charitable fundraising platform, nonprofit solicitation service, or escrow service.
Modak does not custody, administer, escrow, supervise, or monitor how collected funds are ultimately used.
7. Promotional Reward
Eligible approved campaigns may receive a promotional reward equal to 5% of eligible funds successfully collected through the approved payment link.
The following conditions apply:
- Maximum promotional reward: $200 per campaign
- Rewards may take up to 14 days after the campaign ends to be reviewed and issued
- Only completed and non-reversed transactions are eligible
- Refunds, disputes, chargebacks, reversals, unauthorized transactions, or suspected abuse may reduce or eliminate eligibility
Promotional rewards are discretionary promotional incentives and are not deposits, interest, earnings, or guaranteed compensation.
Promotional rewards:
- Are non-transferable
- May not be sold or exchanged
- Have no cash value except as expressly provided through the Program
Modak reserves the right to modify reward structures, matching percentages, campaign limits, or eligibility requirements during the pilot period.
8. Fraud, Risk, and Compliance Review
Modak reserves the right to:
- Review campaign activity at any time
- Request additional information
- Delay, deny, adjust, reverse, or withhold promotional rewards
- Suspend or terminate campaigns
- Restrict account access where permitted under applicable agreements or policies
Modak may withhold, reduce, reverse, or deny rewards associated with:
- Self-funding activity
- Circular transactions
- Artificially inflated contribution activity
- Coordinated abuse
- Account manipulation
- Referral or funding schemes intended primarily to generate promotional rewards
Modak may monitor:
- Transaction activity
- Contribution patterns
- Transaction velocity
- Devices and IP activity
- Refund and dispute activity
- Account behavior
- Linked accounts
- Other operational and fraud-related indicators
Participation in the Program is subject to ongoing fraud prevention, transaction monitoring, operational oversight, and compliance review processes.
Modak may retain support initiative submissions, review records, transaction activity, and related operational records in accordance with applicable legal, regulatory, compliance, fraud prevention, and Sponsor Bank requirements.
9. Organizer Representations
By participating in the Program, you represent and confirm that:
- The information submitted is accurate and not misleading
- You have the appropriate permission or authority to organize and share the support initiative
- You will not use the Program for prohibited or deceptive purposes
- You understand Modak does not verify support initiative claims or beneficiaries
- You understand contributors are solely responsible for deciding whether to contribute
If a minor user participates in the support initiative, the parent or legal guardian remains fully responsible for the associated account and activity.
10. No Endorsement or Verification
Modak does not:
- Endorse any support initiative, organizer, beneficiary, or cause
- Verify the accuracy of support initiative statements
- Guarantee use of funds for any stated purpose
- Guarantee supporting success
- Act as a charity, nonprofit, escrow service, or crowdfunding platform
- This campaign is organized by a Modak user and has not been independently verified by Modak or its partner bank, Legend Bank, N.A. All contributions are voluntary and made at your own discretion. Modak or its partner bank does not guarantee how funds will be used. Modak provides payment processing and promotional incentives only and does not act as a charity, nonprofit, escrow service, or crowdfunding platform.
Contributors participate at their own discretion and risk.
11. Taxes
Participants are solely responsible for any federal, state, or local taxes that may apply related to funds received or promotional rewards issued through the Program.
Modak may issue applicable tax reporting forms where required by law.
Modak does not provide tax advice.
Campaigns are personal in nature and are not charitable solicitations or tax-deductible contributions.
12. Marketing and Promotional Use
If a participant separately opts into marketing consent, Modak may use submitted campaign information, campaign names, testimonials, or related content for marketing, educational, promotional, or community storytelling purposes.
Participation in marketing is optional and is not required for Program approval.
13. Technical Issues
Modak is not responsible for:
- interrupted or unavailable systems
- delayed submissions
- technical malfunctions
- payment processing interruptions
- failed transmissions
- unauthorized access
- system errors affecting participation or reward calculations
14. Program Changes or Termination
This is a limited pilot program.
Modak may modify, suspend, restrict, or terminate the Program or these Terms at any time without prior notice.
15. Liability and Disputes
By entering, you agree to release and hold harmless Modak and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Promotion and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries.
- Limitation of Liability: Modak shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with your participation in the campaign, including but not limited to, prizes, rewards, or any use of or inability to use our services.
- Dispute Resolution: We strive to ensure that participating in the campaign is a positive experience for all involved. In the unlikely event that a dispute arises, we encourage open communication and cooperation to resolve.
THIS PROMOTION IS GOVERNED BY THE LAWS OF THE USA AND DELAWARE, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Promotion, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Promotion, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Delaware having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Promotion), and participant further waives all rights to have damages multiplied or increased.
- Informal Resolution: We believe in resolving disputes amicably and encourage you to first reach out to us directly to discuss any concerns or issues you may have. Our team is here to listen and work with you to find a satisfactory solution.
- Arbitration: If a resolution cannot be reached informally, any disputes, claims, or controversies arising from or related to the campaign shall be resolved through binding arbitration. The arbitration will be administered by a mutually agreed-upon arbitration provider. We believe arbitration offers a fair and efficient way to resolve disputes outside of the courtroom.
- Fair Process: The arbitration will be conducted in accordance with the rules and procedures of the chosen arbitration provider. We assure you that the process will be fair and transparent, and the decision of the arbitrator will be final and binding on all parties involved.
- Costs: Each party shall bear its own costs associated with the arbitration proceedings. We understand that legal proceedings can be daunting, and we strive to minimize any financial burden on all parties involved.
- Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of Delaware, US, without regard to its conflict of law principles.
- Jurisdiction: Any legal action or proceeding arising out of or relating to these terms and conditions or [Name of the campaign] shall be brought exclusively in the courts of Delaware, US, and you hereby consent to the jurisdiction of such courts.
16. Sponsor Bank Disclosure
Deposit account and the Modak Visa® debit card are issued by Legend Bank, N.A., FDIC-Insured.
Modak is a financial technology company and not a bank.
17. Privacy and Security
At Modak, we take the privacy and security of your information seriously. We are committed to protecting your data and ensuring that it is handled responsibly and securely.
Collection of Information: We collect certain personal information from you when you participate in the campaign to facilitate your participation and administer the campaign effectively. This may include information such as your name, email address, and transaction details. Rest assured, we only collect information that is necessary for the campaign and in accordance with our Privacy Policy.
Use of Information: The information collected from you may be used to communicate with you regarding the campaign, notify you of any updates or changes, and facilitate the distribution of prizes or rewards. We may also aggregate and analyze data for statistical purposes to improve our services and offerings.
Security Measures: We have implemented robust security measures to safeguard your personal information from unauthorized access, disclosure, alteration, or destruction. These measures include encryption, firewalls, secure data storage, and regular security audits. We continually review and update our security practices to ensure they meet the highest standards.
Third-Party Partners: In some cases, we may engage third-party service providers to assist us in administering the campaign or providing certain services. These service providers are bound by strict confidentiality agreements and are only authorized to use your information as necessary to perform their services on our behalf.
Data Retention: We will retain your personal information for as long as necessary to fulfill the purposes outlined in this Privacy and Security section, unless a longer retention period is required or permitted by law.
By participating in the campaign, you acknowledge and agree to the terms of this Privacy and Security section and our Privacy Policy.
