Terms and Conditions for Virtual Reward Card Strategy

Introduction

These terms and conditions govern The Virtual Reward Card Strategy.  By using our services, you agree to comply with and be bound by these terms. If you do not agree with any part of these terms, please do not use our services and or participate in the campaign.

Modak will randomly send a $20 virtual reward card to users chosen by the Modak staff. To unlock these $20, the user will have 24 hours to complete the action requested by Modak.

Eligibility

Modak will randomly send a $20 virtual reward card to users chosen by the Modak staff. Selection randomized may include users with the highest or lowest transaction volumes, new or existing users, those with the most or least referrals, and others.

Limits/exceptions:

1. The virtual reward card is personal and non-transferable.
2. If the user fails to fill out the form within the 24-hour timeframe following the email’s dispatch, they will no longer be eligible to participate.

Promotion Period This campaign will be active throughout the month of March 2024.

Prize

1. When the user receives the email confirming the $20, they must take action within 24 hours to receive the $20 in their MoCard.

2. The action required by Modak is to send 4 SMS inviting friends to join Modak’s referral program.

3. These messages should be sent to: 1) individuals in the United States, 2) teens aged 13-17 or parents with children aged 13-17.

4. Once the messages are sent, the user must send a screenshot to the typeform shared in the email.

5. If the user doesn’t complete this action within 24 hours, the virtual reward card will become invalid. No exceptions will be made.

6. If the user completes the action within 24 hours and Modak verifies that the SMS messages were sent correctly, the $20 will be deposited into the MoCard within 3 business days.

Liability and Disputes

• Modak is not responsible for entries not received for whatever reason.
• Any disputes relating to this Promotion will be subject to the exclusive jurisdiction of the courts of the state in which Modak operates.

Representations

By participating in this strategy (or if you are a parent or legal guardian authorizing a minor to participate in the Virtual Reward Card Strategy), you represent and warrant that (i) you are a natural person; (ii) you are at least 13 years of age (or older if you reside in a state where the age of majority is older); (iii) you are a legal resident of the United States; and (iv) you agree to abide by these Terms.

Privacy.

Any personal information you make available to us in connection with the Virtual Reward Card Strategy may be collected, used, and shared by us by Modak Makers’ Privacy Policy, which is available at https://www.modakmakers.com/legal/privacy.

Verification.

• Modak reserves the right to disqualify any participant who violates the terms and conditions or engages in fraudulent activity.
• Modak is not responsible for any technical issues, including but not limited to, internet outages, that may affect participation in the campaign.
• The strategy is subject to all applicable laws and regulations.
• By participating in this strategy, participants agree to abide by these terms and conditions. Modak reserves the right to amend or cancel the strategy at its discretion. Participants are encouraged to review Modak’s privacy policy and terms of service.
• The prize is redeemable within a period of up to 3 weeks from the date of the account creation. Failure to redeem the prize within this timeframe will result in forfeiture of the prize.

Termination and Changes.

Modak Makers may suspend or terminate the Virtual Reward Card Strategy or a user’s ability to participate in the Virtual Reward Card Strategy at any time for any reason. We reserve the right to suspend accounts or remove rewards if we notice any activity that we believe is abusive, fraudulent, or in violation of the Modak Makers Terms of Service or these Terms.

Updates to the Terms.

We can update these Terms at any time without prior notice. If we modify these Terms, we will post the modification on the Websites or in the Application, which are effective upon posting. Continued participation in Virtual Reward Card Strategy after any modification shall constitute consent to such modification.

Governing Law.

The laws of the State of California will govern these Terms, as well as any claim, cause of action, or dispute that might arise between you and Modak Makers, without regard to conflict of law provisions.
