Terms and Conditions for "Refer 1, enter a contest" Strategy

Introduction

These terms and conditions govern The “Refer 1, enter a contest” Strategy.  By using our services, you agree to comply with and be bound by these terms. If you do not agree with any part of these terms, please do not use our services and or participate in the campaign.

Eligibility

Modak will be conducting a draw among all users with 1 referral*, giving away an AirPods (3rd generation) with Lightning Charging Case. To take part in this promotion, referrals made from March 8 to March 18, 2024, will be considered.

• A referral is defined as a user who enters Modak using a referral code, creates an account, and completes a transaction of at least $5 with their MoCard.

Limits/exceptions:

1. Only referrals made between March 8 and March 18 will be considered valid.
2. You only need one referral to participate (a referral is defined as a user who enters Modak using a referral code, creates an account, and completes a transaction of at least $5 with their MoCard.).

Promotion Period This campaign will be active from March 8 to March 18, 2024.

Prize

1. The prize will be an AirPods (3rd generation) with Lightning Charging Case.
2. There will be only 1 (one) winner.
3. The winner will be notified by email on March 18, 2024.
4. The prize will be shipped to the winner’s address at Modak’s expense. Only valid for users in the United States.

Liability and Disputes

• Modak is not responsible for entries not received for whatever reason.
• Any disputes relating to this Promotion will be subject to the exclusive jurisdiction of the courts of the state in which Modak operates.

Representations

By participating in this strategy (or if you are a parent or legal guardian authorizing a minor to participate in the “Refer 1, enter a contest” Strategy), you represent and warrant that (i) you are a natural person; (ii) you are at least 13 years of age (or older if you reside in a state where the age of majority is older); (iii) you are a legal resident of the United States; and (iv) you agree to abide by these Terms.

Privacy.

Any personal information you make available to us in connection with the Virtual Reward Card Strategy may be collected, used, and shared by us by Modak Makers’ Privacy Policy, which is available at https://www.modakmakers.com/legal/privacy.

Verification.

• Modak reserves the right to disqualify any participant who violates the terms and conditions or engages in fraudulent activity.
• Modak is not responsible for any technical issues, including but not limited to, internet outages, that may affect participation in the campaign.
• The strategy is subject to all applicable laws and regulations.
• By participating in this strategy, participants agree to abide by these terms and conditions. Modak reserves the right to amend or cancel the strategy at its discretion. Participants are encouraged to review Modak’s privacy policy and terms of service.
• The prize is redeemable within a period of up to 3 weeks from the date of the account creation. Failure to redeem the prize within this timeframe will result in forfeiture of the prize.

Termination and Changes.

Modak Makers may suspend or terminate the “Refer 1, enter a contest” Strategy or a user’s ability to participate in the “Refer 1, enter a contest” Strategy at any time for any reason. We reserve the right to suspend accounts or remove rewards if we notice any activity that we believe is abusive, fraudulent, or in violation of the Modak Makers Terms of Service or these Terms.

Updates to the Terms.

We can update these Terms at any time without prior notice. If we modify these Terms, we will post the modification on the Websites or in the Application, which are effective upon posting. Continued participation in “Refer 1, enter a contest” Strategy after any modification shall constitute consent to such modification.

Governing Law.

The laws of the State of California will govern these Terms, as well as any claim, cause of action, or dispute that might arise between you and Modak Makers, without regard to conflict of law provisions.
